OWI Conviction Amended for S.P.

Case Victory: Dave’s Story

Dave was unrepresented by counsel when he pled guilty to domestic battery. Even though it was a misdemeanor offense, and given the domestic nature of the conviction under federal law he was prohibited from possessing a firearm. As a truck driver he would occasionally haul equipment for the United States Military and because of the conviction he would not be able to perform his job function. Learning of the problem he contacted Attorney Stangl to initiate an appeal to determine whether there was anything that could be done about his conviction. Attorney Stangl argued in the Court of Appeals that the trial judge failed to comply with certain procedural requirements when it accepted Dave’s plea.

Attorney Stangl previously filed a motion to withdraw the guilty plea, which was denied by the same trial court that he contended failed to comply with the appropriate procedure. The matter was briefed in the Court of Appeals and the State recognized that the court did indeed fail to comply with the appropriate procedure and the Court of Appeals ordered that the trial judge hold a hearing on the issue of its compliance with the appropriate plea procedure.

D.J.'s OWI Conviction Amended

“I am from out of state and was charged with an OWI fist offense and a refusal. Based upon Attorney Stangl’s reputation and the fact that he has won very many difficult OWI cases, it didn’t take me long to hire Attorney Patrick Stangl.

I was impressed immediately with his knowledge, forthrightness, and honesty. He told me from the start that this would be a difficult case but that he would do everything he could to win the case. Because of my employment I simply could not have either a refusal or any type of OWI conviction on my record.

Attorney Stangl proceeded to beat the refusal charge at the Municipal Court trial and I was convicted of the OWI first. During the trial in Municipal Court and through his thorough and aggressive cross-examination of the arresting officer, Attorney Stangl was able to establish how poorly trained the officer was in field sobriety tests and pointed out numerous mistakes which he had made.

We then appealed the OWI conviction to the Circuit Court for a new trial and the charge was amended to reckless driving. Did I forget to mention that the alleged driving conduct, witnessed by the arresting officer, included backing into a building and driving off the end of a raised cement parking lot? Can I appeal a repeat drunk driving conviction in Wisconsin?

You have a constitutional right to appeal any criminal conviction. Attorney Pat Stangl has a strong record of defense appealing OWI convictions for clients facing drunk driving convictions from first offense to repeat offenses in the double digits.

How much will it cost to hire a lawyer in Wisconsin?

The cost of defending against criminal charges will vary depending upon the nature and severity of the charges, the facts of the case, and other factors including the lawyer’s reputation.

At Stangl Law Offices, we usually have a set, two-fee structure for representation in criminal cases. The first fee is a non-refundable retainer that covers all representation at the trial level, unless the case proceeds to a jury or court trial.

If the case proceeds to a jury or court trial, then an additional non-refundable retainer fee is due approximately 2 months prior to the first scheduled jury trial date.

If those fees are not tendered, the firm will withdraw from further representation.

The reason we have a two set fee structure is to allow us to thoroughly investigate, research, and develop defense strategies prior to the determination of whether proceeding to a jury trial is in our client’s best interest or not. That is a joint decision made with the client. Nonetheless, an individual has an absolute right to a jury trial regardless of our assessment of the likelihood of success on the merits.
