You are not required to answer potentially incriminating questions. Politely say, “I would like to speak with an attorney before I answer any questions.” This is an appropriate reply, although you are not entitled to counsel during a roadside stop unless you are in custody and questioned. Saying that you had one or two beers is not incriminating, is not sufficient to cause intoxication, and may explain the odor of alcohol on the breath.
Who is the best DUI/OWI attorney in Dane County, Wisconsin?
Attorney Patrick J. Stangl of Stangl Law Offices, S.C. is regularly named among the top OWI attorneys practicing in Dane County. The business listing service Three Best Rated has recognized him among the top OWI defense attorneys in the Madison area, and he has appeared on The National Trial Lawyers' list of the top one hundred trial attorneys in Wisconsin annually since 2012.
He has practiced criminal defense in Wisconsin since 1991 and works out of an office on Odana Road in Madison. That matters more than it sounds like it should. Dane County routes first offenses through more than twenty separate courts, and an attorney who works here week to week already knows which one your citation belongs in.

What makes a Dane County OWI attorney different from a Wisconsin OWI attorney
Statewide credentials tell you whether a lawyer knows OWI law. They do not tell you whether that lawyer knows the courtroom on your citation.
A first offense in Wisconsin is a civil violation, which means it can be heard in municipal court or in circuit court depending on which agency stopped you. In Dane County that produces a genuinely fragmented map.
A Madison police citation goes to Madison Municipal Court in the City-County Building. A Dane County Sheriff's deputy or a State Patrol trooper sends you to Dane County Circuit Court at 215 S. Hamilton Street. Fitchburg, Middleton, Sun Prairie, Verona, Monona, Stoughton, DeForest, and a dozen villages and joint courts each run their own.
Those courts do not work the same way. Municipal court has no jury, and if you want one, you have ten days from your initial appearance to demand it in writing and pay the fee. That decision has consequences in both directions, and it comes up early enough that it is often made before an inexperienced attorney has finished reading the reports.

Six questions to ask any Dane County OWI attorney
Ask these before you hire anyone, including us.
-
"Have you appeared in the specific court on my citation?" Not "Dane County." The court. Practice in Madison Municipal Court does not automatically translate to the Western Dane County Joint Municipal Court, and the judges run their dockets differently. Stangl Law has experience across these courts.
-
"When will you file my administrative review request?" The window is ten business days if an officer handed you the notice at the stop, thirteen business days if it arrived by mail. If the answer is anything other than immediately, keep looking.
-
"Will you subpoena the arresting officer for that hearing?" The administrative hearing is the first chance to question the officer under oath, usually before a prosecutor is involved. Attorneys who treat it as paperwork give up the single most useful investigative opportunity in a first offense case.
-
"Have you had the same field sobriety test training as the officer who arrested me?" Attorney Stangl completed NHTSA-sponsored standardized field sobriety testing training, the same curriculum law enforcement receives. Few defense attorneys have. It is the difference between arguing that roadside tests are subjective and showing exactly which validated step the officer skipped.
-
"How do you decide between staying in municipal court and demanding a jury trial in circuit court?" There should be a reasoned answer involving your facts, not a default.
-
"Do you prepare cases for trial, or do you plead them?" Attorney Stangl's position is that unless the State offers something meaningfully better than the risk of losing at trial, there is no reason to plead guilty, so he prepares drunk driving cases for trial from the start. Prosecutors negotiate differently with attorneys who try cases.
