You are not required to answer potentially incriminating questions. Politely say, “I would like to speak with an attorney before I answer any questions.” This is an appropriate reply, although you are not entitled to counsel during a roadside stop unless you are in custody and questioned. Saying that you had one or two beers is not incriminating, is not sufficient to cause intoxication, and may explain the odor of alcohol on the breath.
Does Wisconsin have OWI forgiveness?
No. In Wisconsin, the concept of "OWI forgiveness" isn't formally recognized. Operating While Intoxicated (OWI) convictions are treated seriously, and options to remove or reduce such convictions from one's record are extremely limited. They almost never happen, which is why it's so critical to contact an experienced OWI attorney who can help you get your charges reduced or dismissed altogether.
- Expungement: Wisconsin's expungement laws are notably restrictive. Expungement is generally available only for certain offenses committed by individuals under the age of 25 and must be granted at the time of sentencing. Very importantly, OWI convictions are typically ineligible for expungement, meaning they remain on an individual's public record indefinitely.
- Pardon: The Governor of Wisconsin has the authority to grant pardons for state felony convictions. However, this clemency applies exclusively to felony offenses and does not extend to misdemeanors or first-time OWI offenses, which are usually classified as civil offenses. To be eligible for a pardon, an individual must have completed their sentence at least five years prior, maintained a clean record since, and demonstrate a significant need for the pardon, such as for employment or educational opportunities. It's important to note that a pardon doesn't expunge the conviction; the record remains, but certain rights may be restored.
